Terms And Conditions
The Retail Survey Prize Draw is organised by Historic Environment Scotland (“HES”).
HES will collect some personal data from you when you submit a survey response and elect to enter the Prize Draw. This will be restricted to the entrant’s full name, county and email address so that HES can (i) determine an entrant’s eligibility to enter the Prize Draw; (ii) contact the winner and send the winner their prize; and (iii) comply with HES’s legal obligations set out in condition 6.4 and 6.5. When you enter this Prize Draw, you agree to the following terms and conditions.
1. The Promoter
The Promoter of this Prize Draw is Historic Environment Scotland, an executive non-departmental public body, incorporated and established under the Historic Environment Scotland Act 2014, being a registered charity (Scottish Charity number SC045925) and having its principal office at Longmore House, Salisbury Place, Edinburgh, EH9 1SH (“the Promoter”).
2. The Prize Draw
2.1. These terms and conditions apply to the “Retail Survey” Prize Draw (“the Prize Draw”).
2.2. The opening date for entries is 9am on 26th August 2024. Entries must comply with the conditions set out in condition 4 and any entries that do not comply (in the sole opinion of the Promoter) will be disqualified from the Prize Draw.
2.3. The survey Prize Draw will close on 23rd September 2024 at 12noon (“the Closing Date”). Entries must be received by the Promoter, in accordance with condition 4, no later than 12noon on the Closing Date. Entries received after the Closing Date will not be entered into the Prize Draw.
2.4. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
2.5. One winner shall be chosen on 24th September 2024 by a random draw performed by computer process.

2.7. By electing to enter the Prize Draw, you are agreeing to be bound by these terms and conditions.
3. Eligible Entrants
3.1. An “Entrant” is a person submitting a completed survey form and opting to enter the Prize Draw in accordance with condition 4.
3.2. The Prize Draw is not open to employees of the Promoter or their immediate family members.
3.3. Entrants must be over 16 years old and be resident in the UK.
3.4. In entering the Prize Draw, Entrants confirm that they are eligible to do so and eligible to claim the Prize (as defined in condition 5 below) if they are the winner. The Promoter may require Entrants to provide proof that they are eligible to enter the Prize Draw.
4. Entries
4.1. The Promoter shall email a link to the survey to all persons who are currently subscribed to receive retail emails from the Promoter.
4.2. To enter the Prize Draw, Entrants must (i) complete the survey once they receive the link to it; and (ii) elect to enter the Prize Draw which will require them to submit their name, county and email address.
4.3. Any Entries submitted to the Promoter in any other manner or medium will not be eligible to enter the Prize Draw. Only one entry per person is permitted.
4.4. The survey focuses on capturing data about the user experience when visiting www.stor.scot
4.5. If an Entrant does not elect to opt in to the Prize Draw and submit their email address they will not be entered into the Prize Draw.
5. The Prize
5.1. The winner will receive a £100 Stòr voucher by email. This cannot be used at Historic Scotland sites and can be used at https://stor.scot/ only.
5.2. Alcohol and food is not included as part of the voucher.
5.3. The Prize is not transferable nor exchangeable and cannot be taken as cash.
5.4. The Prize is supplied by the Promoter.
6. Notification of winning entry
6.1. The winner, selected in accordance with condition 2.5, will be notified by email from marketing@hes.scot the day after the Closing Date that they are a winner and will be emailed the Prize.
6.2. If the winner is unable to be contacted after reasonable attempts, the Promoter will be entitled to select a new winner in accordance with condition 2.5.
6.3. The Prize may not be claimed by a third party on behalf of the winner.
6.4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of the winner to anyone who emails marketing@hes.scot or writes to the address set out in condition 1 for the Promoter (enclosing a self-addressed envelope) within one month after the Closing Date of the Prize Draw.
6.5. If you object to either or both of your surname and county being published or made available, please contact the Marketing Team, Historic Environment Scotland, Longmore House, Salisbury Place, Edinburgh, EH9 1SH, telephone: 0131 668 8603 or email: dataprotection@hes.scot. In such circumstances, the Promoter will not provide the information to members of the public, but must still provide the information to the Advertising Standards Authority (“ASA”) on request by the ASA, to comply with our legal obligation to do so.
7. Data protection
7.1. As part of submitting an entry to the Prize Draw, Entrants are required to submit certain personal details, including their name, county and email address.
7.2. The Promoter will comply with the Data Protection Act 2018 and the UK General Data Protection Regulation when collecting and otherwise processing personal data in connection with this Prize Draw. Any such personal data will be processed in accordance with the Promoter’s Prize Draw privacy notice https://stor.scot/pages/survey-privacy-notice.
8. Removal or disqualification of entries
8.1. HES reserves the right to disqualify any Entrants that breach these terms and conditions or any entries that, in the sole opinion of the Promoter, are in any way obscene, violent, abusive, discriminatory, defamatory, fraudulent or otherwise unlawful or would damage the reputation of the Promoter.
8.2. Where condition 8.1 applies, the Promoter shall remove any affected entries from the Prize Draw.
9. General
9.1. These Prize Draw terms and conditions are governed by the laws of Scotland. By entering into this Prize Draw, each Entrant agrees to submit to the exclusive jurisdiction of the Scottish courts.
9.2. The Promoter reserves the right to cancel this Prize Draw at any time. The Promoter reserves the right to amend these terms and conditions without notice by posting changes to the Promoter’s website https://stor.scot/pages/retail-survey-prize-draw. The Promoter will only notify Entrants of changes if required to do so by law.
9.3. Insofar as is permitted by law, the Promoter will not in any circumstances be responsible or liable to compensate any Entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of entering into the Prize Draw or taking up a Prize except where it is caused by the negligence of the Promoter or that of its employees. Your statutory rights are not affected.
